A federal judge has rejected OpenAI Inc.’s request to dismiss allegations that the firm violated the ‘Open AI’ trademark of Open Artificial Intelligence Inc., a business with the same name. In a ruling citing emails from users who think it’s connected to OpenAI and a rise in online traffic following the launch of OpenAI’s ChatGPT, Judge Yvonne Gonzalez Rogers found that Open Artificial Intelligence had adequately shown that OpenAI’s branding causes consumer confusion. The U.S. District Court for the Northern District dismissed the trademark claims against executives Samuel Altman and Gregory Brockman, although it upheld Open Artificial Intelligence’s trademark claims against OpenAI.
