Walmart is facing a proposed class action lawsuit for allegedly unlawfully collecting Florida sales tax on delivery fees. According to Mark Rogolino, who presented the case to the U.S. District Court for the Southern District of Florida, Florida law prohibits charging sales tax on delivery fees when customers have the option to pick up their goods. The complaint claims that Walmart displayed “a conscious disregard or indifference to the rights” of the affected customers. The putative class consists of over 2m members who have been impacted in the last four years.
