Litigation finance industry could face pressure

Litigation funding reform is gaining attention from lawmakers and the judiciary, although it is not currently a top priority for the Trump administration. Paul Haskel, a partner at Crowell & Moring, observed: “It’s certainly not the highest priority right now, but there are a few angles that are maybe appealing to the [Trump] administration.” The industry, valued at approximately $15.2bn, faces scrutiny, particularly regarding foreign involvement in U.S. litigation funding. While some Republican lawmakers advocate for increased regulation, the political landscape is complex, with Democrats showing less enthusiasm for regulation. The U.S. Supreme Court’s Advisory Committee is also exploring transparency in funding arrangements, indicating a growing interest in the sector. As the situation evolves, the impact of judicial appointments under Trump could significantly influence the future of litigation funding.
